The ground rules.

These terms govern your access to and use of the Be Noted platform, available at benotednow.com (the “Service”). Read them carefully — they're written to be clear, not to hide anything. By creating an account you confirm you accept them in full.

1. What Be Noted is

Be Noted is a peer support community for people navigating mental and emotional challenges. It is NOT a medical or psychological service, does not replace a therapist, and does not provide diagnoses or treatment. If you are in acute crisis, please contact a local emergency line immediately (see our Safety page).

2. Eligibility

To create an account you must be at least 16 years old and have legal capacity to enter into this contract. Duplicate, automated, or third-party accounts may be removed.

3. Your account

You are responsible for keeping your password secure, not sharing it, and notifying us of any unauthorised access. If your email becomes invalid you may lose access to the Service. We may require additional verification on suspicious activity.

4. Acceptable conduct

Allowed: sharing your experience, listening, asking for and offering support, posting anonymously, creating and joining rooms, using the toolkit (mood, journal, AI companion). Not allowed: harassment, hate speech or discrimination, advertising, spam, impersonation, sexually explicit content, instigation of self-harm, disclosure of third-party personal data, offering therapeutic services, or any unlawful conduct. Violations may result in content removal and immediate suspension.

5. Your content

You retain all rights to the content you create. By posting it you grant us a worldwide, non-exclusive, royalty-free licence to host, display and transmit it within Be Noted while your account exists. If you delete content or your account, the licence ends immediately, except for technical backup copies that are overwritten within 30 days.

6. Moderation

We may review, hide or remove content that violates these terms or the law, and suspend accounts of repeat offenders. Review is performed by humans, not algorithms. If your account is suspended you may appeal by writing to [email protected].

7. AI Companion

The AI Companion is an auxiliary conversational tool. It is not a therapist, must not be relied on in crisis, and its responses do not constitute medical, psychological, legal or financial advice. Messages are processed via an external AI provider in line with our Privacy policy.

8. Payments and subscriptions

Be Noted is free. The Be Noted + subscription is optional, billed monthly or annually through Stripe, and you can cancel any time from your profile; access continues until the end of the paid period. Partial periods are not refunded except where required by law. Prices include VAT where applicable.

9. Service changes

We may modify functionality, add or remove features, and update these terms. For material changes we'll give at least 14 days' notice by email or inside the app.

10. Termination

You can close your account any time from your profile. We may suspend or close accounts that violate these terms or put others at risk, with reasoning when possible.

11. Limitation of liability

The Service is provided “as is”, without implied warranties beyond those required by law. To the maximum extent permitted by law, Be Noted is not liable for indirect damages, lost profits or data loss arising from use of the Service. Nothing in these terms limits liability for fraud, gross negligence or personal injury.

12. Governing law and jurisdiction

These terms are governed by the laws of Spain. Any dispute will be submitted to the courts of Madrid (Spain), unless consumer protection law mandates a different forum.
